PERMISSION FOR MEMBERS OF A RECOGNIZED ORGANIZATION OR CLUB:

If a recognized organization or club (such as a gem/mineral club, school or university group or class, etc.), consisting of at least eight individuals,  would like to plan a field trip to the Property, then the Trip Leader should contact the DH LLC to arrange the date(s) that the group would like to visit. 

Permission can be granted as described above for "Private Individuals".

Alternatively, with prior approval from the DH LLC, the Trip Leader may request that visitors fill out Forms at the site and on the day of the visit.  In this case, the Leader/Organizer must submit the properly filled-out form "CERTIFICATION OF TRIP LEADER" to the DH LLC, preferably at least one month prior to the planned visit. 

If permission is granted, then on the day(s) of the visit, every visitor in the group must legibly and fully fill-out the "ACKNOWLEDGEMENT AND ASSUMPTION OF RISK AGREEMENT AND RELEASE OF LIABILITY" and submit this to the Leader, who must be present at the Diamond Hill Property.  No one in the group is allowed on the Property unless the Form is first filled-out and submitted to the Leader at the site.

After the visit is completed, the Leader must then send to DH LLC all of the Forms, along with one check (equal to $15 per person per day) made out to the Diamond Hill, LLC, no later than 3 (three) days after the visit.  (Note that, for children younger than 16 years of age, the fee is $6/day.  Anyone greater than 64 years old, who does not dig at Diamond Hill [for example, accompanying spouse, surface collector, etc.], is also charged $6/day.  In addition, check with the owners of Diamond Hill LLC for a similar discount for non-diggers younger than 64."  Also, if there are at least eight adults in the group, then there is no fee for the Leader.)

While at the DH LLC, it is the duty of the Trip Leader not to give permission for anyone else to be on the property, unless such person has a properly filled-out Form.  If the Leader asks to see such a Form (a signed verification for permission, or e-mail permit to be on the Property), and none is produced, then the Leader should inform the DH LLC, preferably immediately by phone, or afterwards if no phone is available at the site.  

While at the DH LLC, it is the duty of the visitor not to cross Diamond Mine Road and not to enter the property on that far side of Diamond Mine Road for any purpose.

CHECKLIST  for an  ORGANIZATION  or  CLUB:

3. Immediately after the trip to the Diamond Hill property, send in one envelope to DH LLC:

initialed in ten (10) places, and signed.

    _____  B. One check, made out to "Diamond Hill, LLC", for $15 per person per day.

CERTIFICATION OF TRIP LEADER

(This form is filled-out only if the visit is sponsored by a recognized organization, and if Release Forms are to be submitted at the site.)

The undersigned, ___________________________________, hereby certifies that he/she is organizing a field trip or digging activity for a group of participants, and, acting as the Trip Leader, has requested authorization from the Diamond Hill, LLC, to be permitted access to the Diamond Hill Property in Abbeville County, South Carolina, (the "Property"), for the purpose of conducting a group field trip or group dig for rocks and crystals.  The undersigned acknowledges that he/she is responsible to ensure that group participants have the requisite training to conduct such activities.  The undersigned acknowledges that Diamond Hill, LLC, is not responsible for the supervision of any group participant, and the undersigned certifies that each group participant will be adequately supervised while on the Property.  The undersigned further acknowledges that each group participant must sign an "ACKNOWLEDGMENT AND ASSUMPTION OF RISK AGREEMENT AND RELEASE OF LIABILITY" ("Release Form") before being permitted access to the Property (participants under age 18 must have the Release Form signed by a parent or legal guardian), and by his/her signature below certifies that he/she will collect all signed Release Forms prior to entrance onto the Property.  The undersigned certifies that he/she will not allow any group participant to enter the Property unless that participant has submitted a completed and signed Release Form.

ACKNOWLEDGMENT AND ASSUMPTION OF RISK AGREEMENT AND RELEASE OF LIABILITY

(To be filled-out by every person entering the property of the Diamond Hill, LLC)

In consideration of being permitted access by Diamond Hill, LLC, (DH LLC), to the Diamond Hill Property in Abbeville County, South Carolina ("Property") for the purpose of digging for rocks and crystals, the undersigned agrees to the following Waiver and Release and makes the following representations: 

__________   Initial  Acknowledgment and Assumption of Risk.   I understand the risks associated with digging activities, inherent and otherwise, which include, but are in no way limited to, risks associated with falling into open pits or trenches, the collapse of excavations, equipment failure, negligent use of equipment, injuries from trips or falls.  I understand and acknowledge that Diamond Hill, LLC, by granting permission to access the Property, is in no way making any representation as to any visitor's physical ability to participate in digging activity.  I have no known health problems or medical conditions which could in any way be exacerbated by the planned activity.  I assume all health risks associated with such activity.  I further understand the risks associated with general outdoor activity, and the hazards that may be presented by natural causes or acts of other persons or animals, whether negligent or intentional.

__________   Initial  I understand that Diamond Hill, LLC, by allowing third parties (any other visitors) on the Property, does in no way guarantee, make any representation or assume responsibility for any third party's character or conduct while on or about the Property. 

__________   Initial   Release of Liability.  Diamond Hill, LLC, shall not be liable for any damages arising from personal injuries sustained by me on or about the Property.  I agree to assume and bear all risks of injuries or damages to my person or personal property sustained while on or about the Property caused by any source whatsoever, whether by natural occurrence, my own acts or the acts of others.  I hereby fully and forever release Diamond Hill, LLC, its owners, agents, members, managers, successors and assigns as well as any other person or entity acting in any capacity on its behalf, from all claims, demands, damages, rights of action, or causes of action or liability for any such personal injury or property damage that I may incur.   

__________   Initial   I further specifically agree to assume all risk of personal injury or property damage resulting from the negligence of Diamond Hill, LLC, its owners, agents, members, managers, employees, and all other persons or entities acting in any capacity on its behalf. 

__________   Initial   Indemnification.  I hereby voluntarily release, forever discharge and agree to hold harmless and indemnify Diamond Hill, LLC, its owners, agents, managers, members, successors or assigns and all other persons or entities acting in any capacity on its behalf, from any and all liability, claims, demands, actions, or rights of action, whether known or unknown, foreseen or unforeseen, relating to or arising out of my presence or activities while on or about the property.

__________   Initial   Lawful Activity.  I agree to conduct myself in a lawful manner at all times while on the property, obeying all local, state and federal regulations and laws.

__________  Initial.  I further agree not to cross to the opposite side of Diamond Mine Road from the Diamond Hill Quartz Prospect, and not to enter the property on that opposite side of Diamond Mine Road for any purpose.

__________   Initial   Successors Bound.  This Agreement and all representations made herein shall apply to and bind myself, my heirs, assigns and representatives.

__________   Initial   Severability.  It is my intention that this Agreement be as broad and inclusive as permitted by law.  In the event that any portion of this Agreement is determined to be invalid, such invalid portion shall be severed and the remaining provisions of the Agreement shall remain in full force and effect.

__________   Initial   Governing Law/Jurisdiction.  This Agreement shall be construed in accordance with the laws of the State of South Carolina, and I agree to submit to the jurisdiction of the courts of the State of South Carolina.

The Diamond Hill, LLC, (DH LLC) owns the Diamond Hill quartz digging area (the "Property") near the town of Antreville in Abbeville County, South Carolina.  With prior permission, visitors are allowed to enter the Property and search/dig for rocks and crystals. 

Visitors fall into one of two categories: 

(1) A private group of one or more individuals who desires to visit the Property; 
(2) Members of a recognized organization or club that is sponsoring a field trip to the Property. 
The procedure to gain permission is different for the two categories.

To get permission to visit the Property, you should contact the Manager of the DH LLC (Chester Karwoski), or his wife Gail.
